This course traces the development of human rights from the Magna Carta (1215) to the UN Declaration of Human Rights (1948) and its subsequent constitutional, legislative and judicial interpretations. Students critically examine decisions of the UK and other European courts, the US Supreme Court and supreme courts of the English speaking Caribbean. Emphasis is placed on specific rights (viz. the right to life, the right to property, freedom of expression and freedom of association and assembly) and the mutual responsibility of the State and citizens to each other. The course also seeks to extend students’ critical thinking about the inclusion of human rights and liberties in a constitution and to encourage them to defend positions on the justification for such inclusion orally and in writing.
